By accessing or using VisaCanvas (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these Terms from time to time; continued use constitutes acceptance.
2. Service Description
VisaCanvas is an AI-powered technology tool that helps users organize immigration petition materials. The Service may generate assessment reports, draft documents, criteria mappings, and template letters based on information you provide. All output is produced by artificial intelligence and is intended as a starting point for your own review, not a finished legal product.
3. NOT A LAW FIRM — NO LEGAL ADVICE
VisaCanvas is not a law firm, is not staffed by attorneys, and does not provide legal advice, legal opinions, or legal representation. The Service does not engage in the practice of law. No information provided by the Service should be construed as legal advice for your specific situation. The Service cannot and does not guarantee the legal sufficiency of any generated document or assessment.
4. No Attorney-Client Relationship
Your use of the Service does not create an attorney-client relationship between you and VisaCanvas, its operators, or any affiliated party. Communications with the Service are not protected by attorney-client privilege. If you need legal advice, you should consult a licensed immigration attorney in your jurisdiction.
5. AI-Generated Content Disclaimer
All assessments, documents, and suggestions generated by the Service are produced by artificial intelligence models. AI output may contain inaccuracies, errors, omissions, or outdated information. Specifically:
- Assessment results do not predict or guarantee any immigration outcome.
- Generated documents are drafts that require thorough review and revision by you and/or your attorney before any use in an immigration filing.
- Legal standards, regulations, and USCIS policies change frequently; the Service may not reflect the most current requirements.
- AI may produce content that appears authoritative but is factually incorrect (“hallucinations”).
6. No Guarantee of Outcome
VisaCanvas makes no representation or warranty that use of the Service will result in approval of any immigration petition, visa application, or other immigration benefit. Immigration outcomes depend on many factors beyond the scope of this Service, including but not limited to USCIS adjudicator discretion, policy changes, and the completeness and accuracy of your underlying qualifications.
7. Your Responsibilities
You agree that:
- All information you provide to the Service is accurate, complete, and truthful to the best of your knowledge.
- You will independently verify all AI-generated content before relying on it or using it in any immigration filing.
- You are solely responsible for all decisions regarding your immigration case, including whether and how to use any output from the Service.
- You will seek independent legal counsel from a qualified immigration attorney before submitting any immigration petition or application.
- You will not use the Service for any unlawful purpose, including submitting fraudulent information to immigration authorities.
8. Recommendation to Seek Legal Counsel
We strongly recommend that you consult with a licensed immigration attorney before making any decisions about your immigration case. An attorney can evaluate your specific circumstances, provide personalized legal advice, and represent you before USCIS. The Service is designed to assist your preparation process, not to replace professional legal counsel.
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You acknowledge that the Service processes personal information you provide, including but not limited to your name, academic credentials, publication history, and career information. We do not use your data to train AI models.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISACANVAS AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO: DENIAL OF AN IMMIGRATION PETITION, LOSS OF IMMIGRATION STATUS, DELAYS IN PROCESSING, FINANCIAL LOSSES, OR EMOTIONAL DISTRESS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless VisaCanvas, its operators, affiliates, and their respective officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any immigration filing or application you make using materials generated by or with the assistance of the Service.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
13. Account Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data in accordance with our Privacy Policy.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.
