Immigration outcomes depend on many factors beyond the scope of this Service, including but not limited to USCIS adjudicator discretion, policy changes, and the completeness and accuracy of your underlying qualifications.

7. Your Responsibilities

You agree that:

• All information you provide to the Service is accurate, complete, and truthful to the best of your knowledge.
• You will independently verify all AI-generated content before relying on it or using it in any immigration filing.
• You are solely responsible for all decisions regarding your immigration case, including whether and how to use any output from the Service.
• You will seek independent legal counsel from a qualified immigration attorney before submitting any immigration petition or application.
• You will not use the Service for any unlawful purpose, including submitting fraudulent information to immigration authorities.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISACANVAS AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO: DENIAL OF AN IMMIGRATION PETITION, LOSS OF IMMIGRATION STATUS, DELAYS IN PROCESSING, FINANCIAL LOSSES, OR EMOTIONAL DISTRESS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless VisaCanvas, its operators, affiliates, and their respective officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any immigration filing or application you make using materials generated by or with the assistance of the Service.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

13. Account Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data in accordance with our Privacy Policy.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.
